1. Acceptance of Terms

By accessing and using the PlayPin mobile application ("App"), you agree to be legally bound by these Terms & Conditions ("Terms"). If you do not agree to any part of these Terms, you may not use the App. PlayPin ("we," "us," "our,") reserves the right to modify these Terms at any time. Your continued use of the App following changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to use PlayPin. By creating an account, you represent and warrant that:

  • You are at least 16 years of age;
  • You have the legal authority to enter into these Terms;
  • You have not been previously banned from using the App;
  • All information you provide is accurate, truthful, and complete.

3. Account Creation and Security

To use PlayPin, you must create an account by providing a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your password and account credentials;
  • Notifying us immediately if you suspect unauthorized access to your account;
  • All activities that occur under your account, whether authorized by you or not.

We are not liable for any loss or damage resulting from unauthorized access to your account if the breach was not caused by our negligence.

4. Prohibited Conduct

You agree not to use PlayPin for any unlawful or prohibited purpose, including but not limited to:

  • Harassment, bullying, or abusive behavior toward other users;
  • Creating false, misleading, or fraudulent games or events;
  • Spamming, scamming, or attempting to deceive other users;
  • Using the App for illegal activities or to facilitate illegal behavior;
  • Attempting to reverse engineer, hack, or gain unauthorized access to the App;
  • Impersonating other individuals or entities;
  • Posting obscene, defamatory, or sexually explicit content.

5. User-Generated Content

You retain ownership of any content you create on PlayPin, including game descriptions, profile information, and location details. By posting content, you grant PlayPin a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content solely to operate and improve the App.

You are solely responsible for the content you post. You warrant that your content does not infringe on any third-party rights and does not violate any laws. PlayPin is not responsible for user-generated content and reserves the right to remove any content that violates these Terms.

6. Games and Participation

6.1 Your Responsibility: Participation in pickup sports games is entirely at your own risk. PlayPin does not organize, supervise, insure, or verify games listed on the App. You are solely responsible for:

  • Assessing the safety and legitimacy of any game before joining;
  • Checking that you are physically capable of participating;
  • Following all applicable rules, laws, and venue policies;
  • Taking appropriate safety precautions.

6.2 No Verification: PlayPin does not verify the identities, skills, or intentions of users. We do not screen game creators or participants. You acknowledge the inherent risks of meeting strangers and agree to exercise appropriate caution.

6.3 No Guarantee of Accuracy: Game information, location details, and court availability are provided by users and may be inaccurate, outdated, or false. PlayPin does not verify this information and is not responsible for errors or misrepresentations.

6.4 Cancellations and No-Shows: PlayPin is not responsible for game cancellations, postponements, no-shows, or disputes between participants. Any disputes regarding game arrangements must be resolved directly between users.

7. Location Data

PlayPin uses location services to help you find nearby games. By using the App, you consent to the sharing of your approximate location with other users in games you have joined. We do not guarantee the accuracy of location data or court information. Court locations, hours, and availability may change without notice.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAYPIN IS NOT LIABLE FOR:

  • Any injuries, death, property damage, or illness resulting from participation in games;
  • Theft, loss, or damage of personal belongings;
  • Disputes, conflicts, or violence between users;
  • Inaccurate, misleading, or false information provided by other users;
  • Unavailability, bugs, or errors in the App;
  • Conduct of other users, court operators, or third parties;
  • Any indirect, incidental, special, or consequential damages.

9. Assumption of Risk

You acknowledge that participating in sports activities carries inherent risks of serious injury or death. By using PlayPin to find and join games, you voluntarily assume all risks associated with your participation, whether known or unknown.

10. Termination of Account

PlayPin reserves the right to terminate or suspend your account at any time, with or without notice, if you violate these Terms or engage in unlawful, harmful, or abusive conduct. Termination is at our sole discretion.

11. Intellectual Property

All content, code, design, and functionality of the PlayPin App are owned by or licensed to PlayPin and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PLAYPIN DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR HARMFUL COMPONENTS.

13. Indemnification

You agree to indemnify, defend, and hold harmless PlayPin, its founders, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your participation in any game arranged through the App.

14. Third-Party Services

PlayPin relies on third-party services including PostgreSQL for data storage and Railway for cloud infrastructure. PlayPin is not responsible for any outages, data loss, or service interruptions caused by these third parties.

15. Dispute Resolution

Any disputes arising from these Terms or your use of PlayPin shall be governed by the laws of the applicable jurisdiction and resolved in the competent courts. You agree to submit to the exclusive jurisdiction of these courts.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlayPin and supersede all prior agreements, understandings, and negotiations.
